Important ruling for motorists caught driving too fast in South Africa
A South African court has declared that police arresting and detaining a motorist for speeding without a warrant is unlawful and unconstitutional.
Eastern Cape attorney Hymie Zilwa challenged his 2019 arrest for doing 188km/h in a 120km/h zone, which resulted in him being detained for several hours. The offence occurred near Lainsburg in the Karoo.
